That assumes you are doing your binding from within the console. Have you tried going straight to your config.cfg file and editing the console bind in there?

its the basic theory behind it. theres a coded limitation that wont let you unbind ~, the reasoning for which is probably something along the lines of what i said. although at that point its just conjecture.

Well, unbind - yes, rebind - no. I have successfully unbound what on my SE-layout keyboard is § through my .cfg's. The key is still bound when I first launch hl.exe, but as soon as I execute a .cfg it unbinds. No matter what, I still can't bind another command to it, though.

im a lefty using arrow keys. theres not many keys to use around it but i have 7 or so on my mouse, it works well and its too late to change my ways.

if you want me to i can host all my config files - they could be changed up if you dont have a mouse like mine

i also added a readme file so its easy to understand
