You can die from an opponent's action even if he doesn't have intent to kill you. For example, you could break your neck in a fall, or asphyxiate from a number of sources.

Ahhhh but even the law sees that different to a degree. That is why we have shorter sentences for those who have caused accidental deaths then those who did it with the intent to kill.

At even the basic level it's the difference between premeditation murder and not.
