Senator Bruno has just confirmed that he will be assuming the duties of the Lt. Govenor when Spitzer officially resigns.

Bruno asserted that the Constitution is "clear" on the role he will assume when LG David Paterson moves up to become governor.

Techincally speaking, the seat of the LG will remain empty, but Bruno will assume all the duties of the LG, which includes the tie-breaking vote in the Senate, should that chamber find itself deadlocked, and would be acting governor in the event that Paterson is incapacitated or leaves the state.


The misspelling in the quote is probably due to the fact that this was posted less than 10 minutes after the press conference.

Spitzer gave a pretty good resignation speech today. He's pretty well satisfied me on the matter -- he screwed up, took the heat, resigned, and we can move on.

Of course its more likely that the scandal will take on a life of its own like the Foley incident back in '06, when Foley resigned within hours of the scandal breaking, and the news media insisted on continuing to beat on a dead horse for the next 2 months straight to try and influence election results. But maybe we'll be lucky and I'll be proven wrong here.

I disagree. I don't think "resigning" should be the only penalty for Spitzer. His entire career has been based on draconian use of often obscure financial laws, and it seems fairly certain that he has committed a federal financial crime.

Quitting your job should not mean you get to avoid prosecution for things like wire fraud.

He won't avoid prosecution, as far as I know only the president gets to do that. However, building the case against him will take a LONG time.

I must have missed the part where any of his financial transactions were illegal. As far as I know, the only thing he did that was technically against the law was soliciting sex for money. We might also get a Mann-act prosecution for transporting the woman across state lines for the purposes of sex. But the actual moving of money was merely suspicious, not illegal.

I think they might also get him on money laundering, since concealing the transfer of money for illegal purposes is also illegal.

The list of crimes he could be charged with is just disgusting. Our country is sick in the head if this sort of prosecution occurs.

The crime actually carries the delightful name of "Smurfing." Telling a bank to alter wire transfer records after the fact, (reports in the media say that he went to his bank after a transaction and asked them to remove his name from the wire transfers) would seem to be a pretty clear violation:

Like Randy Cunningham, Eliot Spitzer has violated the Public Trust. The federal prosecutors should throw the book at him and not be light because he has a family.

Also, in his first couple of months as governer, Spitzer got a law passed addressing this issue: "the toughest and most comprehensive anti-sex-trade law in the nation." The legislation was designed to harshly punish those to frequent prostitutes, and also to resolve jurisdictional issues in order to make sure New York law could punish those involved with "sex tourism" from New York to other locales.

This kind of behaviour is not just some obscure "technical" violation of an ancient law. This is exactly how and why Sptizer got elected: because he promised the people of New York he would punish those who committed these acts. To then expect the people would not wish to see him punished by the laws they asked him to pass is silly.
