She signed a plea agreement for a 'lesser charge' thinking that would get rid of any points, happy to just pay the fine and be rid of it. When I explained to her that she may still be hit with points by her own state (not PA, where the ticket was issued) she was doubly pissed. She is now appealing the ruling even though she signed a plea bargan. Guilty convictions can be appealed even if you pled guilty.

I'll get a copy of the appeal form and post it for you so you can see the judicial process at work.


--- IMPORTANT LIGHT UNDER 3 SECONDS ---
As far as I've been able to determine, federal regulations require that lights be NO SHORTER than 3 second yellows under ANY circumstance. So if you got in trouble for a light that is under 3 seconds, you should definately be able to have the charge dismissed if you're willing to show up in court and explain that.

I'm trying to figure out a good way to bring this up with them. At first it doesn't seem to fall under their mandate, but being extorted by the government certainly doesn't promote civil liberties.

Thanks for the links, useful stuff.

To clarify, there are no traffic light cameras involved in my case here. Just a yellow light set too short. Same issue, but in this case a real cop wrote the ticket.

Maybe it's different for non-commercial vehicles I specifically remember having this discussion with a few of my classmates, two instructors and a VA DMV representative. The rep said that the trailer must clear the intersection before the red.

As it turns out a friend of a friend is a civil engi -- I'll be meeting up with her this week to discuss the situation, she's very interested and will help in calling shenanigans on this.



The appeals date has also been verified, its in may -- don't recall the date off the top of my head.

To add more detail to the previous comment, it turns out my friend Lauri is a TRAFFIC ENGINEER! I had no idea until recently.

She has full access to tons of state and federal traffic regulations and standards. She has all the formulas at her fignertips... I'm meeting her for dinner next week and together we shall give PA traffic regulations a new #$hole!

She's going to look up everything I need and provide an engineers assessment for what is or is not proper.
