I did find a link for this though. Kinda makes me nervous to buy from anyone on Ebay now. I would normally trust someone with a 400 rating.

I believe it was a "her", and her rating was perfect. I, however would NEVER pay by check unless it was one from my CC company because they carry fraud insurance.

This has happened a lot with xbox 360 on ebay and most of them completely apply to ebays rules. My favorite one was the "xbox 360 special edition. Box Only"
Everywhere on the page it clearly stated that the guy was just selling the box but still it had about 26 bids and the lucky guy who bought the box payed something like $900. The only thing really deceiving about it is exploiting lazy ebay buyers who just look at the pictures instead of the info. It's all there fault and not the seller's. You can't sue someone for being stupid. Well, atleast not anywhere outside the us.

Edit: just looked at the picture one for the first time and what he did was pretty sketchy, it was only one small line in there saying it was a picture. But most of these fake auctions clearly state in capslock what they actually are.
