Its illegal (not to mention immoral). They are selling copyrighted material ie: the picture. Unless they took that picture themselves, they can be sued by Microsoft.

It is not illegal to sell a picture of something. However, it is against eBay's TOS to list an item in such a way as to easily decieve. I see a lot of this on paintball related items.

Correct. But he not selling it as his own. He is simply selling the picture of the box. I can take a picture of any household item and sell it. He is not claiming that he created the Microsoft logo or xbox or anything like that. He is not selling it as an orginal piece of work/art.

I "heard" that the guys account was suspended but the buyer was refused any refund because it was stated in the fine print. Personally i dont see how these two things can sit together. If he did something wrong the buyer should get his money back but i supppose they are worried about setting a precedent. Undoubtedly the seller has a new email address and account on ebay already.
