He's not deaf nor retarded, he can still pose a threat, he never repented, and even if he had it wouldn't bring those people back from the dead. Same with Tookie, but I didn't want to get involved in that argument.

Guilt, innocence and morality aside, I believe there is a law that states an inmate cannot be executed if they are in poor health. Not sure if it's state or federal, however. So, if the law applies and he's in poor condition because of his bad ticker, no execution.
Kinda funny, in a sense; gotta make sure someone is healthy before you kill them.

With regard to applying the sentence in cases like this - wherein the convicted develops serious health issues in between the conviction and sentencing and the 25 years of appeals - I don't see any reason to overturn the judge and jury's decision. When Pinochet was arrested I didn't think "that poor old man" but rather "damn that took a long time."
Lots of sick old men should have died a long time ago. The people they killed should have lived. He was tried, he was convicted. WHILE SERVING TIME for the first conviction he committed crimes, was tried again, and was again convicted, this time with special circumstances. Whether this guy has diabetes of butt-syphilis is irrelevant. The appeals process was there to ensure that his rights were protected and to scrutinize the procedings that lead to his death sentence. That process is nearly complete, and so is he. |

What a perfect example of why life imprisonment != death penalty. People serving life sentences can retaliate.
Once again, the only travesty I see is the length of time it took to exhaust his appeals. I want to see death sentences carried out within two years while there's still a chance we're executing the monster and not the sweet, repentant, cuddly inmate he evolved in to. |

I set up my Tivo to record the news station, Thoroughly enjoying the momentous occasion. It seemed Lady Justice had gotten her way And there would be one less savage today. When outside the jail there arose such a clatter The cameras turned to see what was the matter. When what to my civilized eyes did appear? But a lineup of actors, all liberal, half queer. The misguided freaks drew some curious looks Proclaiming his innocence and clutching his books. The tears then flew out from Sarandon’s eyes As she nominated him for another Nobel Peace Prize. The actors were tethered to an ACLU sleigh All towing the line of, “Urban decay.” On Asner, on Penn, on liberal cop-haters, On Sharpton, on Jesse and all other race-baiters. Then at 00:30 all curled up like a beetle, Tookie cried as they gave him the needle. When up from the actors there arose such a cry. They had failed in their mission and Tookie did die. I heard Bill O’Reilly say as I turned out my light, Merry Christmas to all … there was justice tonight!
