If she just goes to the bathroom, then nothing. If she "whips it out", then I presume she could be prosecuted for indecent exposure, just as a man could be prosecuted for indecent exposure if he flashed his genitals to another man in a men's room.

While I'm sure laws vary from state to state, I'm fairly certain that whipping it out while in the bathroom is going to be difficult to prosecute. That's what bathrooms are for...

But let's overlook that and just imagine leejo sitting in the women's room. And "she" is not doing anything but staring at every single woman that comes in. What then?

If you just mean loitering around in the women's room making them feel mildly uncomfortable and not looking up their skirts or anything, then there's no law against staring. How is that situation different from the possibility of a lesbian sitting in a women's room and staring? Or those creepy old guys that hang around YMCA locker rooms?

The difference is that currently, if leejo goes into the women's room and sets up camp, they can simply call security to haul him out. Now, thanks to the new proposal, all he has to do is hold up his birth certificate that show's he's "female," and they can't touch him without a lawsuit.

If you think there's no difference between a man sitting in the women's room staring and a lesbian sitting in a women's room staring, I encourage you and a lesbian friend to go camp out in the closest public female restroom and see who gets tossed first.

Who says I'll carry my birth certificate around with me? NONO! After the police cause me at least seven-figures' worth of mental anguish by humiliating me in front of everyone I'll sue the City and we'll settle for a tidy sum.

This will rock on college applications too. Did I say I'm a white male, Duke? I meant I'm a women! An oppressed, sensitive, woman.

They should make race optional too, while they're at it.

Just because there's a loophole in the law that lets gay people do it doesn't mean we should create a loophole that allows straight people to do it too.

So only gay people get to change their sex to female even though they have a chromosome and a wang that say otherwise? OK then I'll say I'm gay, and God help the City if they dare humiliate me by saying I'm not.

This isnt just a matter of making and inny and outtie or vice versa and saying "ok, now you are a (boy/girl)" surgery doesnt change DNA. Your birth certificate should have to go according to what can be scientifically and genetically proven, not what is cosmetic.

Having the surgery is a personal choice, DNA is not.

Im not one of those people wh oare anti-abortion, anti-gay marraige, etc... I just dont think that this makes sense and its a horrid waste of time, effots and resources when all of these things should be focused on more worthwhile things.

Who says I have to be gay to enact this change? What if I'm a man that likes women, but thinks that I should have been born a woman? How does that work out? Technically I'm heterosexual pre- birth certificate change.

Here's another interesting situation. Say this goes through. Can a team of NBA superstars change their birth certificates to say "Female" and go play in the WNBA?

There are so many flaws to this proposal; I can't believe that anyone is actually supporting it. And, frankly, I think it belittles the actual issues surrounding the whole GLBT argument. Do you honestly think something as simple as checking a different box on a birth certificate is going to suddenly make people accept that which they currently do not?

In either case, I fully support your battle to be the first verbally gay female with a ding-dong sipping whiskey in the ladies room, leejo. Call me if you need a lawyer.
