I can and I have. The rule is that each player gets two "freebie" violations, but on the third the other player can, if he wishes, claim victory.
If this were an "open" tournament with lots of people who didn't have connections to each other, then a rule like this wouldn't work that well, but given that most people are playing because they want to play and win by tactical thought rather than game technicality, the majority will choose to continue on the game unless it's starting to get frustrating to play out (1 turn every 16 hours, for example).
But even if we weren't all connected to each other playing in a small tournament, I think a rule that gives the discretion to the opponent is fine. Other tournament sites do use this discretion (for example, TWL encourages players not to "call" games on technicalities if it wouldn't have changed the outcome).
But if you can't play, you can't play. That's unfortunate, but it's life.
