    Does "Fair" = "Equal"?

I think they're not the same. I think the US was founded on Fairness and not Equality. The definition of fairness has changed over the years and a lot of history & government classes in school seemed to use them interchangeably, as if equal rights for all automatically meant fair treatment for all. That's true for certain categories: "race" or "gender", but I think it's not true for others like "criminal record".

Just wondered what everyone else thought, since I'm guilty of saying I'm for Equal Rights when I'm really for Fair Rights. The problem is that Equal is easier to define in a court of law...

Actually, our constitution is based on equal rights. The word fair is never used or implied in my opinion (and as we've seen several times this year the interpretation of the constitution is based on opinion).

I believe in equal opportunties not equal outcomes (not my line, but I like it, so I'm going to use it).

Trying to be fair means manipulating results which I think is beyond the scope or ability of our government. After all it is up to the government to regulate, legislate or judiciate those outcomes isn't it?

I believe we (not just Americans, but Humans) excel, invent, and prosper when we are left the hell alone. There will always be sexism, racism, wars, religions, criminals, etc. People will be taken advantage of, period. Governments can help to mitigate some of it, but they cannot overcome the Human animal. In their attempt to control behavior they stifle productivity.

Just my opinion and worth what you paid for it.

Our original constitution was based on "equal rights" if you were a free (non-slave) male citizen over 18 who was literate and could afford to travel to the nearest ballot box. To them that was fair, but even then a lot of people knew it wasn't equal (hence the days-long deadlock over outlawing slavery).

I like the statement about equal opportunities, whatever the source... I guess I was more looking at Equal relating to a communistic outlook because of everyone having the right to certain goods regardless of whether they've earned them. So I guess it depends more on your definition of Rights than your definition of Equal? The way the whole Cruel and Unusual Punishment clause has been twisted to protect the most horrible people turns my stomach.

Kinda off topic, but Abercrombie and Fitch are being accused of racism because they want to fill their stores with mostly white, young, good looking sales associates. Is this racism? Is it a violation of anyone's rights if a company hires people that fit a certain image?

Nice can of worms there Cing. I would say yes, if it precludes certain races/ethnical groups from doing the job that they are perfectly capable of doing. Tough call though..

So... This means that our BET (Black Entertainment Television) has to start hiring white people to host their shows (it currently has nothing but black hosts)?

I think this is BS. Just like Hooters doesn't have to hire men as waiters, companies that are providing a product or service that has a certain image as an integral part of the business shouldn't be expected to hire people that don't fit that image.

    true enough.

It kinda depends on the product. Hooters or whoever sell the staff as part of the product, tits etc.

A shop is selling clothes, not the person inside them, although I can see your point about the associated image.

And BET, another great big discussion. Racism goes both ways. I figure we all worry too much about this kinda crap

    Indeed.

Unfortunately, the sheer number of lawyers over here has forced people to worry about this kinda crap...

This is what you must deal with when you are part of a majority race...IT IS racist for the majority to act like the majority.
